Yatasbedding Hungary Webshop

These General Terms and Conditions (hereinafter: GTC) define the general terms and conditions of product sales contracts concluded between Gálabau Kft. and the customers of the webshop available through the yatasbedding.hu website ("Yatasbedding Hungary Webshop") as absent parties.

2. Special Provisions
2.1 The scope of the GTC extends to all goods available for purchase in the Yatasbedding Hungary Webshop and shall apply without limitation as an inseparable part of the sales contracts concluded between absent parties regarding these goods. The language of the contract is Hungarian.
2.2 A contract concluded through the Yatasbedding Hungary Webshop is not considered a written contract; however, Gálabau Kft. assigns a unique contract identifier to all sales transactions and registers the contracts using this identifier. We ensure subsequent access to the contracts upon request.
2.3 Gálabau Kft. does not submit itself to the provisions of any code of conduct, and beyond what is stated in section 1, it is not a member of any professional interest representation body (chamber).
2.4 Purchasing in the Yatasbedding Hungary Webshop requires the acceptance of these GTC as an inseparable part of the individual contract formed. Gálabau Kft. ensures through technical means that buyers explicitly declare their acceptance of these GTC before making a purchase in the Yatasbedding Hungary Webshop. By accepting these GTC, you agree that Gálabau Kft. provides you with the necessary information through these GTC and the yatasbedding.hu website.
2.5 These GTC are available and can be saved, stored, and subsequently retrieved without any restrictions by all users visiting the Yatasbedding Hungary Webshop, thus their precise content can be reviewed before placing an order for a sales contract and checked afterwards. Gálabau Kft. also makes previously effective versions of the GTC available on the yatasbedding.hu website.
2.6 Gálabau Kft. acts on its own behalf in legal transactions covered by the GTC.
2.7 Commercial resale or further sale of products sold in the Yatasbedding Hungary Webshop is not permitted. The Yatasbedding Hungary Webshop reserves the right to refuse any contractual offer where there is a suspicion that the offer was made for commercial resale or further sale (e.g., in case of ordering quantities not typical for household use). If a buyer who is not a consumer resells a product purchased from Gálabau Kft., they must obtain written permission from Gálabau Kft. If the buyer fails to fulfill their notification obligation, Gálabau Kft. will continue to consider the buyer as the owner of the product and the rightful claimant of any claims arising from defective performance.
2.8 If, despite all due care and diligence of Gálabau Kft., an incorrect price is displayed, Gálabau Kft. is not obliged to sell the product/service at the incorrect price, but may offer the buyer performance at the correct and actual price, in which case the buyer may withdraw from their purchase intention. An incorrect price includes, in particular, a clearly erroneous price that significantly differs from the known price of the product concerned; possibly a "0" HUF or "1" HUF price appearing due to a system error; or any other price indicating a striking disproportion in value. Gálabau Kft. excludes its liability arising from data entry errors, erroneous, incorrect, etc. price displays to the fullest extent permitted by law.
2.9 The selling prices of products and services offered for sale in the Yatasbedding Hungary Webshop, indicated on the product page in Hungarian Forints, already include value-added tax (gross prices).
2.10 Gálabau Kft. does not, as a general rule, conclude contracts of continuous performance. If Gálabau Kft. were to conclude a contract of continuous performance, the buyer would receive adequate information about the shortest duration of the contract and the price to be accounted for in the given billing period (which is always a one-month period in case of a constant price) or the method of determining the price.
3. Webshop Visit
3.1 Minors or persons with limited legal capacity may only use the services of the Yatasbedding Hungary Webshop with the consent of their legal representative.
3.2 By using the Yatasbedding Hungary Webshop, the buyer declares that they have understood and acknowledged the terms of use contained in the GTC and the privacy statement, and accept the conditions of using the Yatasbedding Hungary Webshop.
3.3 If the buyer does not accept the GTC or does not consent to the relevant data processing activities, they must immediately cease using the Yatasbedding Hungary Webshop.
3.4 The stock information displayed in the Yatasbedding Hungary Webshop is for informational purposes only and refers to the moment the Yatasbedding Hungary Webshop database was updated. Yatasbedding Hungary Webshop makes every effort to keep this data up-to-date, but does not guarantee it due to rapid stock movements.
4. Process of Concluding a Sales Contract
4.1 A sales contract for products offered in the Yatasbedding Hungary Webshop can be concluded by placing an electronic order, as specified on the yatasbedding.hu website, following the steps offered there. In the product catalog of the Yatasbedding Hungary Webshop, products can be searched and selected by product group and keyword search. Information about the characteristics, types, gross price, available colors and sizes, and estimated delivery time of the product you wish to order can be found by clicking on the product's name or image. When you add a product to your cart, you can modify the order and delete items from the cart on the cart page.
4.2 If everything is correct on the order summary page, you can finalize your order by clicking the "Place Order" button and send it to Gálabau Kft. Otherwise, you can go back to the previous page to correct data entry errors or withdraw from the purchase intention. Placing an order entails a payment obligation.
4.3 You can find information about the accepted payment methods on the yatasbedding.hu website. Gálabau Kft. will in no case charge a fee for using a specific payment method that exceeds the costs incurred by it in connection with that payment method. The delivery fee is not affected by the chosen payment method.
4.4 The contractual terms of the chosen third-party payment provider (e.g., in the case of Simplepay, the payment method provided by OTP Mobil Kft.) are always applicable in connection with the payment transaction. The third-party payment provider may charge a fee for its services in connection with the payment transaction. These service fees are not considered consideration for the product provided by Gálabau Kft., do not constitute revenue for the Yatasbedding Hungary Webshop, and their amount is not determined by Gálabau Kft. In the case of cash on delivery, the purchase price of the product and the shipping fee are both settled through the delivery service provider.
4.5 We will confirm receipt of your order by email within 48 hours at the latest, which will act as a durable medium confirming that we have received your order, and will also include the details of your order, links to these GTC, the Privacy Policy, and warranty cards, from which these documents can be downloaded. The confirmation email is considered a confirmation of the contract on a durable medium in accordance with Section 12 (2) of Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses, for the application of which the consumer gives their consent by accepting these GTC.
4.6 The contract comes into effect upon the arrival of the confirmation email to you. If the confirmation email does not reach you within 48 hours of sending your order, you are released from your contractual obligation. An order or its confirmation is considered received when it becomes accessible to the addressee. Gálabau Kft. bears no responsibility if the confirmation does not arrive because the buyer provided an incorrect email address, or if the email account storage is full, or for any other reason making it inaccessible to them.
4.7 If the ordered product is not available at the time of the order, or the product marked "available for order" cannot be procured within the timeframe indicated on the website, the Yatasbedding Hungary Webshop reserves the right not to accept the order for the goods, or to offer different conditions (e.g., if it is uncertain whether such goods can be ordered), in which case no contract will be concluded. The buyer will be notified of this. Gálabau Kft. will refund any payments made by the buyer in such cases.
4.8 If the buyer only notices a data entry error based on the confirmation email, they may initiate its correction within 1 working day by sending an email to the email address provided in point 1. Gálabau Kft. considers this a proposal for contract modification and suspends the performance of the contract until the correction is made based on the inquiry and the buyer confirms the correctness of the corrected data.
4.9 By placing the order and accepting the provisions described in the GTC, the buyer expressly agrees to receive the electronic invoice issued by Gálabau Kft. and to download it from the link forwarded to the email address provided in the order.
4.10 The electronic invoice is prepared by KBOSS.hu Kereskedelmi és Szolgáltató Korlátolt Felelősségű Társaság (1031 Budapest, Záhony utca 7.) on behalf of Gálabau Kft. The data provided during invoicing will not be forwarded to third parties by the service provider, but will be archived and retained for the period specified in the relevant legislation. The electronic invoice issued by Gálabau Kft. is an accounting document issued electronically that is suitable for tax administrative identification and regulated by accounting and VAT laws. The original electronic invoice, as an authentic document, certifies the existence of tax payment obligations and rights, therefore electronic invoices must be retained in electronic form according to the relevant legislation.
5. Contract Performance
5.1 With the sales contract, Gálabau Kft. undertakes to deliver the product and the Buyer acquires ownership of the product; while the buyer undertakes to take over the product/digital content from Gálabau Kft. and pay its purchase price.
5.2 After receiving the order, we strive to deliver the ordered product(s) as soon as possible to the Hungarian address you specified. If you order multiple products simultaneously, the products will be delivered together, meaning the delivery time of the product with the longest delivery time will be applicable. For the purposes of this point, the performance deadline is considered fulfilled even in case of an unsuccessful delivery attempt (the person authorized to receive the product(s) is not available at the delivery address at the time of delivery).
5.3 If you notice any damage to the product or packaging upon receipt, you must request the courier to draw up a report of the damage.
5.4 The delivered product remains the property of Gálabau Kft. until the full payment of the purchase price has been made.
6. DISCOUNTS
6.1 The Yatasbedding Hungary Webshop constantly offers discounted products. In the case of these products, the individual discounted price is valid while stocks last. Further occasional conditions may also apply to discounts.
6.2 The following restrictions must be taken into account when using certain discounts:
● further (individual/membership) discounts cannot be applied to products with a discounted price;
● time-limited/expiring discounts are only valid and usable during the specified period; and
● discounts (individual/membership) cannot be combined or accumulated.
7. Warranty for defects, Guarantee
7.1 The terms and conditions applicable to consumers regarding the warranty for defects and guarantee are communicated and made part of these GTC as follows:

In what cases can you exercise your right to a warranty for defects?
You can assert a claim for warranty for defects against Gálabau Kft. in case of defective performance by Gálabau Kft., according to the rules of the Civil Code.
What rights are you entitled to based on your claim for warranty for defects?
You can – at your choice – assert the following claims for warranty for defects:
You can request a replacement, unless the fulfillment of your chosen claim is impossible or would incur disproportionately high additional costs for Gálabau Kft. compared to the fulfillment of your other claim. If you have not requested, or could not have requested, repair or replacement, you may request a proportionate reduction of the consideration, or you may repair the defect yourself at the expense of Gálabau Kft., or have it repaired by someone else, or - as a last resort - you may withdraw from the contract. You may switch from your chosen right to a warranty for defects to another, but you bear the cost of the switch, unless it was justified or Gálabau Kft. was the cause.
Within what deadline can you assert your claim for warranty for defects?
You are obliged to notify the defect immediately after its discovery, but no later than two months from the discovery of the defect. However, Gálabau Kft. draws your attention to the fact that you can no longer assert your rights to a warranty for defects after the two-year limitation period from the performance of the contract.
Against whom can you assert your claim for warranty for defects?
You can assert your claim for warranty for defects against Gálabau Kft.
What other conditions apply to the assertion of your rights to a warranty for defects?
Within six months of performance, there are no other conditions for asserting your claim for warranty for defects beyond notifying the defect, if you prove that the product was provided by Gálabau Kft. However, after six months from performance, you are obliged to prove that the defect you discovered already existed at the time of performance.
7.3 Mandatory guarantee
In what cases can you exercise your right to guarantee?
In case of defective performance, Gálabau Kft. is obliged to provide a guarantee based on Government Decree 151/2003. (IX. 22.) on the mandatory guarantee for certain durable consumer goods. The (material) scope of the decree applies only to new products sold within the framework of a consumer contract concluded in Hungary and listed in the annex to the decree.
What rights are you entitled to under the guarantee and within what deadline?
The duration of the guarantee (the guarantee period) begins with the actual performance, i.e., the day the product is handed over to you. The duration of the guarantee is:
a) one year for a selling price reaching HUF 10,000 but not exceeding HUF 100,000,
b) two years for a selling price exceeding HUF 100,000 but not exceeding HUF 250,000,
c) three years for a selling price above HUF 250,000.
Failure to meet this deadline results in forfeiture of rights. The guarantee does not cover defects whose cause arose after the product was handed over to you.
If you assert a claim for replacement due to a product malfunction within three working days of purchase, Gálabau Kft. is obliged to replace the product, provided that the malfunction hinders its intended use.
During repair, only new parts may be installed in the product.
For asserting a guarantee claim, the rules applicable to the exercise of rights to a warranty for defects shall apply mutatis mutandis.
When is the enterprise exempt from its guarantee obligation?
Gálabau Kft. is exempt from its guarantee obligation only if it proves that the cause of the defect arose after performance.
Regarding mattresses, we emphasize that the guarantee does not cover wear and tear resulting from natural use. Gálabau Kft. does not undertake a guarantee investigation of mattresses that are not in a hygienic condition. We cannot accept complaints regarding mold if it is the result of excessively high humidity or inadequate ventilation. The mattress is fundamentally dimensionally stable, but a small deformation during use is allowed, which is a maximum of 12% of the mattress height. A deformation smaller than this is not considered a defect. We cannot accept complaints arising from comfort issues if an unsuitable firmness of mattress was chosen. Complaints regarding damage can be reported at the time of product receipt, or at the latest within 3 days of product receipt; after this, it is considered proven that the defect arose after the product was handed over.
Gálabau Kft. draws your attention to the fact that you cannot assert claims for a warranty for defects and a guarantee, or product warranty and a guarantee simultaneously for the same defect; however, you are otherwise entitled to the rights arising from the guarantee independently of the aforementioned entitlements.
8. Product Warranty
8.1 The terms and conditions applicable to product warranty for consumers are communicated and incorporated into these GTC as follows, in accordance with the sample information provided in Annex 3 of Government Decree 45/2014. (II. 26.) on the detailed rules of contracts between consumers and businesses:
In what cases can you exercise your product warranty right?
In case of a defect in a movable item (product), you may - at your choice - enforce your right to warranty for defects as defined in the previous point or a product warranty claim.
What rights are you entitled to based on your product warranty claim?
As a product warranty claim, you may only request the replacement of the defective product.
When is a product considered defective?
A product is defective if it does not comply with the quality requirements in force at the time of its placing on the market or if it does not have the properties described by the manufacturer.
Within what period can you enforce your product warranty claim?
You can enforce your product warranty claim within two years from the date the product was placed on the market by the manufacturer. After this period, you lose this right.
Against whom and under what other conditions can you enforce your product warranty claim?
You can exercise your product warranty claim exclusively against the manufacturer or distributor of the movable item. You must prove the defect of the product when enforcing a product warranty claim.
In what cases is the manufacturer (distributor) exempt from its product warranty obligation?
The manufacturer (distributor) is exempt from its product warranty obligation only if it can prove that:
– it did not manufacture or place the product on the market within the scope of its business activities, or
– the defect was not discoverable at the time of placing on the market according to the state of science and technology, or
– the defect of the product results from the application of a legal regulation or a mandatory official regulation.
It is sufficient for the manufacturer (distributor) to prove one reason for exemption.
Gálabau Kft. draws your attention to the fact that you cannot simultaneously enforce warranty for defects and product warranty claims for the same defect. However, if your product warranty claim is successfully enforced, you can enforce your warranty for defects claim against the manufacturer for the replaced product or repaired part.
9. Voluntary Warranty
9.1 For certain products, Gálabau Kft., or the manufacturer or importer of the product, may undertake a voluntary warranty beyond the mandatory warranty. Information on the conditions of such warranty is provided on the warranty card.
10. Withdrawal
10.1 In the case of a contract concluded in the Yatasbedding Hungary Webshop, you, as a consumer, have the right to withdraw from the contract without giving reasons within fourteen (14) days from the day you or a third party designated by you, other than the carrier, take(s) possession of the product(s) delivered based on the given order. If for any reason products related to a given order are delivered at different times, the deadline for exercising the right of withdrawal shall be calculated from the receipt of the last delivered product.
10.2 The right of withdrawal as per the previous point may also be exercised before receiving the product(s). The declaration must be sent to the contact details of Gálabau Kft. specified in point 1 of these GTC, by post or e-mail. You exercise your right of withdrawal within the deadline if you send your declaration of withdrawal before the expiry of the deadline specified above.
10.3 As a consumer, you can also exercise your right of withdrawal by filling out the sample withdrawal form available on the yatasbedding.hu website (DOWNLOADABLE HERE) or by any other unambiguous statement to that effect. You bear the burden of proving that you have exercised your right of withdrawal in accordance with the provisions specified in this point.
10.4 If you, as a consumer, withdraw from the contract concluded with Gálabau Kft. as described in the previous point, Gálabau Kft. shall reimburse the total amount paid by you as consideration, including costs incurred in connection with the performance, such as transport costs, no later than fourteen days after receiving your declaration of withdrawal. If you have expressly chosen a method of transport other than the least costly ordinary method of transport, Gálabau Kft. is not obliged to reimburse the additional costs arising therefrom.
10.5 Gálabau Kft. shall reimburse the amount due to you as a consumer in case of withdrawal as described above using the same payment method you used. Based on your express consent, Gálabau Kft. may also use a different payment method for reimbursement, but you shall not be charged any additional fees arising therefrom. If you purchased the product(s) affected by the withdrawal by cash on delivery, you expressly agree that Gálabau Kft. will reimburse the amount due to you by one of the following methods:
● by transferring the appropriate amount to the bank account provided by you; or
● by sending cash by post.
10.6 If you withdraw from the contract concluded through the Yatasbedding Hungary Webshop as described above, you are obliged to return the product without delay, but no later than fourteen days from the notification of withdrawal, to the address specified in point 1 of these GTC, or to hand it over in person at the address of the Brand Representation Warehouse specified in point 1 of these GTC. The return is considered to have been made within the deadline if you send the product before the expiry of the deadline.
10.7 You bear the direct cost of returning the product.
10.8 Gálabau Kft. may withhold the amount refundable in case of withdrawal until Gálabau Kft. has received the product back, or you have unequivocally proven that you have returned it; the earlier of the two dates shall be taken into account.
10.9 The buyer is responsible for any depreciation resulting from use beyond what is necessary to determine the nature, characteristics, and functioning of the product, and Gálabau Kft. is entitled to deduct this from the purchase price.
10.10 You cannot exercise your right of withdrawal for sealed products that cannot be returned for health or hygiene reasons after being unsealed after delivery.
11. LIABILITY
11.1 Gálabau Kft. limits its liability for damages towards the buyer to the broadest extent permitted by Hungarian law, to the amount of the purchase price of the products purchased by the buyer. To the broadest extent permitted by law, Gálabau Kft. excludes its liability for damages related to the performance of this contract with regard to consequential damages, damages to third parties, and loss of profit.
11.2 Gálabau Kft. is not responsible for delayed delivery or other damages resulting from any force majeure, including but not limited to strikes, manufacturer delays, consequences of the COVID-19 pandemic, extraordinary central administrative measures, weather obstacles, or natural disasters.
11.3 Gálabau Kft. excludes all liability if the delivery delay or other problem occurred due to inaccurate and/or incorrect data provided by the buyer.
11.4 Gálabau Kft. excludes all liability for the conduct of users of the yatasbedding.hu website. The user of the yatasbedding.hu website is solely and fully responsible for their own conduct, and Gálabau Kft. fully cooperates with the authorities within the legal framework to detect any legal violations.
11.5 The yatasbedding.hu website may contain links pointing to the pages of other service providers, but Gálabau Kft. does not assume responsibility for the activities or data protection compliance of these service providers. Gálabau Kft. does not assume responsibility for the compliance with legal regulations or the content of advertisements, promotional materials, or other information placed by third parties on the Yatasbedding Hungary Webshop. The party for whose benefit the advertisement was published is responsible for such content.
11.6 The objective of Gálabau Kft. is to sell the goods found in the Yatasbedding Hungary Webshop. The images and colors displayed for individual items are illustrations, and therefore may differ from reality. Gálabau Kft. handles information on the internet with due care, the information found in the Yatasbedding Hungary Webshop has been placed in good faith, but it is for informational purposes only, Gálabau Kft. does not assume responsibility for the accuracy, completeness of the information, or any errors or typos in the database. The packaging and box images shown for the products are for illustrative purposes, generally corresponding to what the buyer actually receives, but deviations are possible here too, for which Gálabau Kft. also assumes no responsibility (e.g., the product is available with the same content but in different packaging than what is shown in the picture).
11.7 Gálabau Kft. does not assume any liability in particular for:
a) any malfunction in the internet network, or obstruction of its use based on these malfunctions, disturbances, and the consequences arising therefrom;
b) the loss, non-arrival, delay of any data, or even sent or received e-mail, and the consequences arising therefrom. For e-mails ending up in the Junk/Spam/Promotion etc. folder due to improper functioning of the spam filter on either the sender's or receiver's side, and the consequences arising therefrom, possible loss, deletion; as well as
c) any malfunction in any communication line, whether on the sender's or receiver's side, or on any of the intermediate channels. For the improper functioning of any software used during the transaction. For the consequences of any system or program error, extraordinary event, or technical error.
12. Customer Service
12.1 Gálabau Kft. is interested in ensuring that you are fully satisfied with the service of the Yatasbedding Hungary Webshop, therefore, it welcomes any feedback.
12.2 For matters related to the Yatasbedding Hungary Webshop, inquiries are accepted at the email address info@yatasbedding.hu or by post. In case of postal inquiries, please write "Yatasbedding Magyarország webáruház" on the envelope.
13. Enforcement Options
Complaint Handling
13.1 If our customer service is unable to provide a satisfactory and reassuring answer to your inquiry, please send your comments and complaints to info@yatasbedding.hu. Please refer in your complaint to the consultation held with the Yatasbedding Hungary Webshop and the circumstances of the unsuccessful consultation.
13.2 If we agree with your complaint, we will remedy it without delay and send you a substantive response within 30 days of receiving the complaint. If we do not agree with your complaint, or if it cannot be investigated immediately, we will record the complaint and our position on it in a report, and send it to you no later than with the substantive response. If we do not agree with your complaint, we will explain it in our substantive response.
13.3 In case of rejection of the complaint, Gálabau Kft. will inform you in writing about which authority or conciliation body's procedure you can initiate, depending on the nature of your complaint. The information will also include the registered office, telephone and internet contact details, and mailing address of the competent authority or the conciliation body according to the consumer's place of residence or stay. The information will also cover whether Gálabau Kft. will use the conciliation body procedure to settle the consumer dispute.

Other enforcement options
13.4 If a consumer dispute between Gálabau Kft. and the consumer is not resolved during the complaint handling process, the following enforcement options are available to you.
13.5 Lodging a complaint with consumer protection authorities. If the consumer notices a violation of their consumer rights, they are entitled to turn to the consumer protection authority competent according to their place of residence. After evaluating the complaint, the authority decides on conducting the consumer protection procedure.
13.6 Conciliation body. For the out-of-court, peaceful settlement of consumer disputes related to the quality, safety of products, and the application of product liability rules, as well as the conclusion and performance of the contract, you can initiate a procedure with the conciliation body competent according to your place of residence or stay. For the purposes of the rules on conciliation bodies, a civil organization, church, condominium, housing cooperative, micro, small, and medium-sized enterprise are also considered consumers if they purchase, order, receive, use, or utilize goods, or are the addressee of commercial communication or an offer related to goods. 13.7 Court proceedings. You are entitled to enforce your claim arising from the dispute before a court in civil proceedings, as provided for in the relevant legal regulations.
13.8 Online dispute resolution platform. To settle consumer disputes, you have the option to submit a complaint on the European online dispute resolution platform, which is available here: https://ec.europa.eu/consumers/odr/
14. Copyright Terms, Database Rights
14.1 Copyrighted works found on the Yatasbedding Hungary Webshop (including, but not limited to, graphic designs and photographs) are protected by copyright, over which Gálabau Kft. reserves all its rights. Gálabau Kft. reserves the right to take action for damages or on other legal grounds against anyone who records the content of the yatasbedding.hu website without permission.
15. Technical Conditions
15.1 Gálabau Kft. declares that the security level of the operational information system of the Yatasbedding Hungary Webshop is adequate, its use does not pose a risk, however, it recommends that the user take the following precautions: use virus and spyware protection software with an updated database, install security updates for the operating system. The use of the website presupposes the user's knowledge of the technical and technological limitations of the Internet and acceptance of the error possibilities and risks associated with the technology.
15.2 The provisions regarding the tools and measures used to protect the data managed by Gálabau Kft. are contained in the Data Management Information available on the yatasbedding.hu website.
16. Scope and Amendment of GTC
16.1 The GTC applies to sales contracts concluded during its period of validity. The GTC ceases to be valid for sales contracts concluded thereafter upon the issuance of new (amended) general terms and conditions, or by withdrawal. Gálabau Kft. reserves the right to amend or withdraw these GTC at any time. The issuance of new GTC generally does not affect sales contracts concluded under the scope of these GTC and does not modify their content. If the new GTC somehow affects sales contracts concluded under the scope of these GTC, you may withdraw from the contract.
17. FINAL PROVISIONS
17.1 For provisions not regulated in these GTC, Hungarian law shall apply.
