These General Terms and Conditions (hereinafter: GTC) define the general terms and conditions of product sales contracts between Gálabau Kft. and the customers of the online store ("Yatasbedding Magyarország Webáruház") available via the yatasbedding.hu website, as absentees.

2. Priority provisions

2.1 The scope of the General Terms and Conditions covers all goods that can be purchased in the Yatasbedding Magyarország Web Store and applies without limitation as an inseparable part of sales contracts between absent parties. The language of the contract is Hungarian.

2.2 The contract concluded through the Yatasbedding Magyarország Webstore is not considered to be in writing, however, Gálabau Kft. assigns a unique contract identifier to all sales transactions, with which the contracts are registered. Subsequent access to the contracts is provided upon request.

2.3 Gálabau Kft. does not submit to the provisions of the code of conduct, and is not a member of a professional interest representation body (chamber) in addition to the provisions of point 1.

2.4 The condition for purchasing at the Yatasbedding Magyarország Web Store is the acceptance of these General Terms and Conditions as an inseparable part of the resulting individual contract. Gálabau Kft. ensures by means of technical means that, prior to purchases made in the Yatasbedding Magyarország Webstore, it obtains the express declaration of the customers regarding the acceptance of these General Terms and Conditions. By accepting these Terms and Conditions, you agree that Gálabau Kft. will provide you with the necessary information via these Terms and Conditions and via the yatasbedding.hu website.

2.5 These General Terms and Conditions can be saved and stored on an accessible and durable data medium, and can be called up later without any restrictions for all users visiting the Yatasbedding Magyarország Web Store, so that its exact content can be known before placing an order for the conclusion of sales contracts and can be checked afterwards. Gálabau Kft. also makes previously effective versions of the General Terms and Conditions available on the yatasbedding.hu website.

2.6 Gálabau Kft. acts in its own name during legal transactions covered by the General Terms and Conditions.

2.7 The commercial resale or resale of products sold in the Yatasbedding Magyarország Webstore is not permitted. Yatasbedding Magyarország Webárüház reserves the right to reject any contractual offer in which there is a suspicion that the offer was made for the purpose of commercial resale or resale (e.g. in the case of ordering in non-household quantities). If the customer who is not a consumer resells the product purchased from Gálabau Kft., he must obtain written permission from Gálabau Kft. If the customer does not comply with his obligation to notify, Gálabau Kft. continues to consider the customer the owner of the product and the rightful owner of all claims resulting from defective performance.

2.8 If, despite all the care and prudence of Gálabau Kft., an incorrect price is indicated, then Gálabau Kft. is not obliged to sell the product/service at the incorrect price, but can offer the customer the correct and actual price, knowing which the customer may abandon his purchase intention. In particular, an obviously wrong price, which differs significantly from the well-known price of the product in question, is considered a wrong price; HUF "0" or HUF "1" price that may appear due to a system error; other price showing striking value disproportion. Gálabau Kft. from data entry errors, incorrect, incorrect, etc. excludes its liability arising from price display to the fullest extent permitted by law.

2.9 The sales prices of the products and services offered for purchase by Yatasbedding Magyarország Webárühz on the product page, given in Hungarian forints, already include VAT (gross prices).

2.10 As a general rule, Gálabau Kft. does not enter into continuous performance contracts. If Gálabau Kft. were to enter into a contract with continuous performance, the customer will receive adequate information about the shortest duration of the contract and the price (or the method of determining the price) to be settled in the given billing period (which is always a one-month period in the case of a fixed price).

3. Online store visit

3.1 Minors or persons with limited capacity to act may only use the services of the Yatasbedding Magyarország Webáruház with the consent of their legal representative.

3.2 By using the Yatasbedding Magyarország Web Store, the customer declares that he/she has understood and acknowledged the terms of use in the General Terms and Conditions and the Data Protection Statement, and accepts the terms of use of the Yatasbedding Magyarország Web Store.

3.3 If the customer does not accept the General Terms and Conditions or does not agree to the relevant data management activities, he/she must immediately stop using the Yatasbedding Magyarország Web Store.

3.4 The stock information displayed by the Yatasbedding Magyarország Webstore is informative and refers to the moment when the database of the Yatasbedding Magyarország Webstore was updated. Yatasbedding Magyarország Webáruház does everything to ensure that these data are up-to-date, however, due to the rapid movement of stock, it does not guarantee them.

4. The process of creating a Sales Agreement

4.1 It is possible to conclude a sales contract for the products offered in the Yatasbedding Magyarország Webstore by placing an order electronically, in the manner specified on the yatasbedding.hu website, by following the steps offered there. In the product catalog of the Yatasbedding Magyarország Webstore, products can be searched and selected by product group and keyword search. You can find out about the characteristics, types, gross price, available colors and sizes, estimated delivery time of the product you want to order by clicking on the name of the product or the image of the product. When you add the product to the cart, you can modify the order on the cart page and delete an item from the cart.

4.2 If everything is fine on the order summary page, you can finalize your order by clicking the submit order button and send it to Gálabau Kft., otherwise you can go back to the previous page to correct data entry errors or cancel your purchase. The order entails a payment obligation.

4.3 You can find information about accepted payment methods on the yatasbedding.hu website. Gálabau Kft. will in no case charge a fee for the use of the given payment method that exceeds the costs incurred in connection with the payment method. The price of home delivery is not affected by the chosen payment method.

4.4 In the case of the selected third-party payment service provider (e.g. Simplepay, the payment method provided by OTP Mobil Kft. is governed by the contractual conditions of the used payment service provider in all cases. The third-party payment service provider may charge a fee in connection with the payment transaction as consideration for the service it provides. These service fees cannot be considered as consideration for the product provided by Gálabau Kft., they do not constitute the income of the Yatasbedding Magyarország Webáruház, their amount is not determined by Gálabau Kft. .

4.5 We will confirm receipt of your order by e-mail within 48 hours at the latest, which as a permanent data medium confirms that we have received the order you sent, and also contains the details of your order, the present GTC, the Data Management Information and the links to the warranty cards, from which these links can be downloaded documents. 45/2014 on the detailed rules of contracts between the consumer and the business, the confirmation email is considered as a confirmation of the conclusion of the contract on a durable data medium. (II. 26.) In accordance with the provisions of Section 12 (2) of Government Decree, to the application of which the consumer gives his consent by accepting these General Terms and Conditions.

4.6 The contract is established when you receive the confirmation email. If you do not receive the confirmation email within 48 hours of sending your order, you will be released from the contractual obligation. The order or its confirmation is considered received when it becomes accessible to the recipient. Gálabau Kft. bears no responsibility in the event that the confirmation is not received because the customer provided an incorrect e-mail address, the e-mail account is full of storage space, or is not accessible for other reasons.

4.7 If the ordered product is not available at the time of the order, or if the product indicated as "available to order" cannot be obtained within the period indicated on the website, the Yatasbedding Magyarország Webáruház reserves the right not to accept the order of the product, or to accept different conditions recommend (e.g. if it is uncertain whether such goods can be ordered) in this case no contract will be concluded. The customer will be notified of this. In such cases, Gálabau Kft. will refund any possible payment to the customer.

4.8 If the customer notices a data entry error only based on the confirmation email, he can initiate correction of the error within 1 working day based on the confirmation email by sending an email to the email address specified in point 1. Gálabau Kft. regards this as a proposal to amend the contract and suspends performance of the contract until, based on its request, the repair is carried out and the customer confirms the correctness of the corrected data.

4.9 By accepting the order and the GTC, the customer expressly consents to receive the electronic invoice issued by Gálabau Kft. and to download it from the link sent to the e-mail address specified in the order.

4.10 The electronic invoice is prepared by KBOSS.hu Kereskedelmi és Szolgáltató Korlátolt Feleősségő Társaság (1031 Budapest, Záhony utca 7.) on behalf of Gálabau Kft. The service provider will not pass on the data provided during invoicing to third parties, they will be archived and kept for the period specified in the relevant legislation. The electronic invoice issued by Gálabau Kft. is an accounting receipt suitable for tax administration identification, issued electronically regulated by the accounting and VAT laws. The original electronic invoice, as an authentic document, proves the existence of the obligations and rights related to tax payment, therefore invoices issued electronically must be preserved in electronic form according to the relevant legislation.

5. Contract performance

5.1 With the sales contract, Gálabau Kft. undertakes to deliver the product and the Customer acquires ownership of the product; while the customer undertakes to receive the product/digital content from Gálabau Kft. and to pay its purchase price.

5.2 After receiving the order, we will endeavor to deliver the ordered product(s) to the Hungarian address indicated by you as soon as possible. If you order several products at the same time, the products will be delivered together, i.e. the delivery time of the product with the longest delivery time will be decisive. In the interpretation of the provisions of this clause, the delivery deadline is considered fulfilled even in the event of an unsuccessful delivery attempt (at the time of delivery, the person authorized to receive the product(s) cannot be reached at the delivery address).

5.3 If you notice damage to the product or packaging during delivery, you must ask the courier to record the damage.

5.4 The delivered product remains the property of Gálabau Kft. until the purchase price is paid in full.

6. DISCOUNTS

6.1 In the Yatasbedding Magyarország Web Store, we always have discount products. In the case of these products, the special discount price lasts while stocks last. Additional case-by-case conditions may apply to discounts.

6.2 In connection with the use of certain discounts, the following restrictions must be taken into account:
● no additional (individual/membership) discount can be applied for discounted products;
● fixed-term/expiration discounts are valid and can be used only during the specified period; as well as
● it is not possible to combine or accumulate discounts (individual/membership).

7. Accessory warranty, guarantee

7.1 The conditions applicable to consumers regarding accessory warranty and warranty are disclosed and made part of these GTC as follows:

In which case can you exercise your accessory warranty right?
In the event of defective performance by Gálabau Kft., you can enforce a warranty claim against Gálabau Kft. according to the rules of the Civil Code.
What rights are you entitled to based on your warranty claim?
You can – according to your choice – make use of the following accessory warranty claims:
You can request a replacement, unless the fulfillment of the request you have chosen is impossible or would involve disproportionate additional costs for Gálabau Kft. compared to the fulfillment of another request. If you did not or could not ask for the repair or replacement, you can request a proportional delivery of the compensation or you can repair the defect at the expense of Gálabau Kft. You can transfer from your chosen accessory warranty right to another, but you will bear the cost of the transfer, unless it was justified or Gálabau Kft. gave it a reason.
What is the deadline for asserting your warranty claim?
You are obliged to report the error immediately after discovering it, but no later than within two months of discovering the error. At the same time, Gálabau Kft. draws your attention to the fact that you can no longer assert your accessory warranty rights beyond the two-year limitation period from the completion of the contract.
Who can you enforce your accessory warranty claim against?
You can enforce your accessory warranty claim against Gálabau Kft.
What other conditions are there for asserting your accessory warranty rights?
Within six months from the date of delivery, there is no other condition for validating your accessory warranty claim, apart from reporting the defect, if you prove that the product was provided by Gálabau Kft. However, after six months have passed since the performance, you are already obliged to prove that the defect you recognized was already present at the time of performance.

7.3 Mandatory Warranty
In which case can you use your warranty right?
151/2003 on the mandatory warranty for certain consumer durables in case of faulty performance. (IX. 22.) Based on a government decree, Gálabau Kft. is obliged to provide a guarantee. The (objective) scope of the decree only applies to the products sold within the framework of the new consumer contract concluded in Hungary and listed in the annex to the decree.
What rights are you entitled to under the warranty and within what time frame?
The warranty period (the warranty period) begins with the actual performance, i.e. the day the product is handed over to you. Warranty period:
a) one year in the case of a sale price of HUF 10,000 but not exceeding HUF 100,000,
b) two years in the case of a sale price exceeding HUF 100,000 but not exceeding HUF 250,000,
c) three years above the selling price of HUF 250,000.
Failure to meet this deadline will result in loss of rights. The defect is not covered by the warranty if its cause occurred after the product was handed over to you.
If you request a replacement within three working days of the purchase due to a malfunction of the product, Gálabau Kft. is obliged to replace the product, provided that the malfunction prevents the intended use.
During the repair, only new parts may be installed in the product.
In order to validate the warranty claim, the rules for the exercise of accessory warranty rights must also be properly applied.
When is the company released from its warranty obligation?
Gálabau Kft. is released from its warranty obligation only if it proves that the cause of the defect arose after performance.
Regarding mattresses, we emphasize that the warranty does not apply to wear and tear resulting from natural wear and tear. Gálabau Kft. does not undertake the warranty examination of a mattress in an unhygienic condition. We cannot accept complaints about mold if it is the result of too high humidity or inadequate ventilation. The mattress is basically shape-retaining, but a small amount of deformation is allowed during use, which means that the mattress height is max. 12% of it. Deformation of less than this is not considered a defect. In the case of choosing a mattress of inadequate hardness, we cannot accept complaints arising from the feeling of comfort. Complaints regarding damage can be reported upon receipt of the product, but no later than within 3 days of receipt of the product, after which it is considered proven that the defect occurred after the delivery of the product.
Gálabau Kft. would like to draw your attention to the fact that due to the same defect, you cannot assert a claim for accessory warranty and warranty, or a claim for product warranty and warranty at the same time, in parallel with each other, but otherwise you are entitled to the rights arising from the warranty regardless of the rights defined above.

8. Product warranty

8.1 The conditions applicable to consumers regarding the product warranty are set out in Regulation No. 45/2014 on the detailed rules of contracts between the consumer and the company. (II. 26.) In accordance with the sample information contained in Annex 3 of the Government Decree, we publish and make it a part of these GTC as follows:
In what cases can you use your product warranty right?
In the event of a defect in a movable thing (product), you may - at your choice - assert your accessory warranty right or product warranty claim defined in the previous point.
What rights do you have based on your product warranty claim?
As a product warranty claim, you can only request the replacement of the defective product.
In which case is the product considered defective?
The product is defective if it does not meet the quality requirements in force at the time it was placed on the market or if it does not have the properties described by the manufacturer.
What is the deadline for asserting your product warranty claim?
You can assert your product warranty claim within two years of the product being placed on the market by the manufacturer. After this deadline, you will lose this right.
Against whom and under what other conditions can you enforce your product warranty claim?
You may only exercise your product warranty claim against the manufacturer or distributor of the movable item. You must prove the defect of the product in the event of a product warranty claim.
In what cases is the manufacturer (distributor) exempt from product warranty obligations?
The manufacturer (distributor) is only released from its product warranty obligation if it can prove that:
– the product was not manufactured or marketed as part of its business activities, or
- the defect was not recognizable according to the state of science and technology at the time of placing it on the market or
- the defect of the product results from the application of legislation or mandatory official regulations.
It is sufficient for the manufacturer (distributor) to prove one reason for exemption.
Gálabau Kft. would like to draw your attention to the fact that due to the same defect, you cannot assert a claim for accessory warranty and product warranty at the same time, in parallel with each other. However, if your product warranty claim is successfully asserted, you can assert your accessory warranty claim for the replaced product or repaired part against the manufacturer.

9. Voluntary warranty

9.1 In the case of certain products, Gálabau Kft., or the manufacturer or importer of the product, may undertake a voluntary warranty in addition to the mandatory warranty. We provide information on the terms of such a warranty on the warranty card.

10. Withdrawal

10.1 In the case of a contract concluded in the Yatasbedding Magyarország Webáruházn, you, as a consumer, have the right of withdrawal without reason within fourteen (14) days from the date of receipt of the product(s) delivered based on the given order by you or by a third party other than the carrier indicated by you. . If, for some reason, the products related to a specific order are delivered at different times, the deadline for the right of withdrawal shall be calculated from the receipt of the last delivered product.

10.2 The right of withdrawal according to the previous point can also be exercised before receiving the product(s). The declaration must be sent to the contact details of Gálabau Kft. indicated in point 1 of these GTC, by post or e-mail. You exercise your right of withdrawal within the deadline if you send your withdrawal statement before the deadline indicated above.

10.3 You, as a consumer, can exercise your right of withdrawal by filling out the sample withdrawal statement on the yatasbedding.hu website and by any other clear statement to that effect. You are responsible for proving that you have exercised your right of withdrawal in accordance with the provisions set out in this section.

10.4 If you, as a consumer, withdraw from the contract with Gálabau Kft. in accordance with the provisions of the previous point, Gálabau Kft. will refund the entire amount paid by you as compensation, including the costs incurred in connection with the performance, no later than fourteen days from the receipt of your declaration of withdrawal. , for example the cost of transport. If you have specifically chosen a mode of transport other than the least expensive usual mode of transport, Gálabau Kft. is not obliged to refund the resulting additional costs.

10.5 Gálabau Kft. will refund the amount due to you, as a consumer, in the same way as the payment method used by you, in case of cancellation in accordance with the above. Based on your express consent, Gálabau Kft. may use another payment method for the refund, but you may not be charged any additional fees as a result. If you purchased the product(s) affected by the cancellation by cash on delivery, you expressly agree that Gálabau Kft. will reimburse you the amount refunded in one of the following ways:
● by transferring the appropriate amount to the bank account specified by you; obsession
● by sending the cash by post.

10.6 If, in accordance with the above, you withdraw from the contract concluded through the Yatasbedding Magyarország Web Store, you must return the product immediately, but no later than fourteen days from the notification of withdrawal, to the address indicated in point 1 of these GTC, or return it in person to the Brand Representative indicated in point 1 of these GTC At warehouse. The return is considered completed within the deadline if you send the product before the deadline.

10.7 You bear the direct cost of returning the product.

10.8 Gálabau Kft. may withhold the amount due in the event of cancellation until Gálabau Kft. has received the product back, or you have proven beyond doubt that you have returned it; of the two, the earlier date must be taken into account.

10.9 The buyer is responsible for any depreciation that occurs due to use exceeding the use necessary to determine the nature, properties and operation of the product, which Gálabau Kft. is entitled to deduct from the purchase price.

10.10 You may not exercise your right of withdrawal with respect to a product in closed packaging that cannot be returned after opening after delivery for reasons of health protection or hygiene.

11. LIABILITY

11.1 Gálabau Kft. limits its liability for damages to the customer to the extent permitted by the rules of Hungarian law to the amount of the purchase price of the products purchased by the customer. To the fullest extent permitted by law, Gálabau Kft. excludes its liability for damages related to the performance of this contract in terms of consequential damages, damages to third parties and lost profits.

11.2 Gálabau Kft. is not responsible for delayed delivery or other damages resulting from any force majeure, including work stoppages, manufacturing delays, the consequences of the COVID-19 pandemic, extraordinary central administrative measures, weather obstacles or natural disasters.

11.3 Gálabau Kft. excludes all responsibility if the delivery delay or other problem occurred due to inaccurate and/or incorrect data provided by the customer.

11.4 Gálabau Kft. disclaims all responsibility for the behavior of the users of the yatasbedding.hu website. The user of the yatasbedding.hu website is solely and fully responsible for his own conduct, Gálabau Kft. fully cooperates with the acting authorities within the legal framework in order to detect possible violations of the law.

11.5 The yatasbedding.hu website may contain links that point to the pages of other service providers, however, Gálabau Kft. assumes no responsibility for the activities of these service providers or their compliance with data protection. Gálabau Kft. assumes no responsibility for the legal compliance and content of advertisements, promotional materials, and other information placed by third parties on the Yatasbedding Magyarország Web Store. The responsibility for these contents rests with the person on whose behalf the advertisement was published.

11.6 The purpose of Gálabau Kft. is to sell goods found in the Yatasbedding Magyarország Webáruház. The images and colors displayed for each item are illustrations, so they may differ from reality. a) for any malfunction in the Internet network, or for the obstruction, disruptions and consequences of its use based on these errors;
b) for the loss, non-arrival, delay of any data or e-mails sent or received and the resulting consequences. Either on the sender's side or on the recipient's side, due to the improper operation of the spam filter, the letters are classified as Spam/Spam/Promotion, etc. for being placed in a folder, as well as for the resulting consequences, possible loss or deletion; as well as
c) for any failure in any communication line, either on the side of the sender or the receiver, or on any of the intervening channels. 13. Legal enforcement options

Complaint handling

13.1 If we are unable to provide a satisfactory and satisfactory answer to your inquiry through our customer service, please write us your comments and complaints to the e-mail address info@yatasbedding.hu. 13.3 If the complaint is rejected, Gálabau Kft. will inform you in writing about which authority or conciliation body can initiate the procedure with your complaint - according to its nature. The information also includes the headquarters, telephone and internet contact details, and mailing address of the competent authority and the conciliation body based on the consumer's place of residence or stay. The information also covers whether Gálabau Kft. uses the conciliation board procedure in order to settle the consumer dispute.

Other Remedies

13.4 If the consumer dispute between Gálabau Kft. and the consumer is not settled during the complaint handling, the following legal enforcement options are open to you.

13.5 Filing a complaint with consumer protection authorities. If the consumer detects a violation of his consumer rights, he is entitled to file a complaint with the competent consumer protection authority according to his place of residence. After evaluating the complaint, the authority decides on the conduct of the consumer protection procedure.

13.6 Conciliation Board. In order to resolve consumer disputes related to the quality, safety and application of product liability rules as well as the conclusion and performance of the contract out of court, you may initiate a procedure at the conciliation body competent according to your place of residence or residence. In the application of the rules relating to the conciliation body, a consumer is also a non-governmental organization, church, apartment building, housing association, micro, small and medium-sized enterprise according to a separate law who buys, orders, receives, uses, makes use of goods, or commercial communication related to the goods, recipient of the offer. 13.7 Court Proceedings. In accordance with the provisions of the relevant legislation, you are entitled to enforce your claim arising from the legal dispute before the court within the framework of civil proceedings.

14. Copyright terms, database rights

14.1 The author's creations on the Yatasbedding Magyarország Webstore are under copyright protection (including especially graphic images and photographs), over which Gálabau Kft. reserves all its rights. If the new General Terms and Conditions affect sales contracts concluded under the scope of these General Terms and Conditions in some way, you may withdraw from the contract.

17. FINAL PROVISIONS

17.1 Provisions not regulated in these GTC are governed by the rules of Hungarian law.
